Marijuana was used for pain relief, Sarnia court told

A Lambton County man using marijuana for pain relief was handed a 15-day jail sentence in Sarnia court.

Jordon Harold Richards, 33, pleaded guilty to possession of marijuana on Wednesday.

Richards was arrested during an OPP raid of a Petrolia home. At the time of the raid, the OPP had been investigating and targeting a different man for drug trafficking, the court heard, but Richards was living in this man's house.

A glass jar containing 13 grams of marijuana was found on a coffee table during the raid. Two marijuana plants were also in the home.

Defence lawyer Sarah Donohue said Richards had suffered a serious leg injury during an accident and had been using marijuana for pain relief.

Due to a limited income, Richards had been unable to afford getting government approval for medical marijuana use, Donohue said.

A joint submission by Crown and defence lawyers was presented for a 15-day sentence due to Richards' record.

The jail time will be served on weekends so Richards can continue working.

Justice Deborah Austin recommended that Richards serve his time at the Sarnia jail.

Due to ongoing renovations at the Sarnia jail, weekend sentences are usually served at a designated facility in London. Sarnia-area people are required to transport themselves to London, but that would be a problem for Richards, who relies on others for transportation, Donohue said.

Austin made the recommendation while acknowledging where a sentence is served is determined by corrections ministry staff.
