Lakeport Planning Commission to consider possible amendments to medical marijuana cultivation ordinance

LAKEPORT, Calif. – Next month the Lakeport Planning Commission is set to discuss possible updates to the city's ordinance governing medical marijuana cultivation.

The commission will meet at 5 p.m. Wednesday, Feb. 8, in the council chambers at Lakeport City Hall, 225 Park St.

Up for discussion are possible amendments to the Lakeport Zoning Ordinance Section 17.38 concerning the regulation of medical marijuana cultivation.

Consideration will be given to the development of procedures for the cultivation of marijuana for non-commercial personal use.

Amendments under consideration reflect state regulations associated with the recent passage of Proposition 64, the Adult Use of Marijuana Act, or AMUA, in 2016 and regulations associated with the 2015 passage of legislation collectively known as the Medical Marijuana Regulation and Safety Act, or MMRSA.

The Planning Commission will consider the following:

• A short discussion on the difference between commercial and non-commercial marijuana cultivation;
• Number of marijuana plants on a residential property allowed for personal use;
• Indoor cultivation of marijuana for personal use;
• Outdoor cultivation of Marijuana for personal use;
• The permitting process for cultivation of Marijuana for personal use in the city of Lakeport;
• Any other issues associated with noncommercial personal marijuana cultivation.

Retail sales and processing of cannabis will not be a part of the discussion on Feb. 8.

The city of Lakeport is dividing legalized marijuana uses into two categories: commercial and noncommercial.

At this time, the city is developing regulations for cultivation of marijuana for noncommercial personal use on residential properties only.

The public is encouraged to attend and participate.

Following that meeting the city will develop an ordinance for the regulations for noncommercial personal use marijuana cultivation, and return to the planning commission for review of the ordinance and approval by the Lakeport City Council.
